What You Need To Know About Zostavax Lawsuit

By Frances Hill

So many vaccines have been manufactured over the centuries, but some of them have been found to be ineffective and dangerous. When this happens, the vaccine has to be canceled from the market and is no longer usable. Shingle is an infection that is caused by a dormant Varicella Zoster Virus that reactivates in the body. This happens after one contracts Chickenpox or Varicella during childhood. The virus remains in the spinal cord and brain and revives after many years as shingles virus. The vaccine that was developed is supposed to help the body fight the infection. However, people filed cases against this vaccine, and the following is an illustration of why the Zostavax Lawsuit is Legit.

The people who develop shingles tend to be above 50years of age. Also, these people must have had chickenpox at a younger age. There are other issues like physical trauma, stress and immune problems that may make a person more vulnerable to contracting the virus. The vaccine is effective for people who are above 50 years old.

However, this vaccine only works for about fifty percent of the people. Also, its effects last for about six years. Most patients are immunocompromised, which means they cannot fight even the weakened form of the shingles virus. Therefore, these patients have a risk of developing shingles if they are vaccinated with the Zostavax vaccine. Most patients who were immunized using this vaccine alleged to have developed severe injuries like hearing loss, paralysis, blindness and fatal liver failure.

The people that developed these injuries filed indictments against the shingles vaccine. These claims showed that Merck and Company had prior knowledge of the effects of the vaccine way before and during the pre and post-market approval. They, however, did not disclose this until seven years later after being approved by the FDA.

Currently, there are more than fifty claims that have been filed against Merck and CO, the pharmaceutical company that developed the drug. The indictment claims that the vaccine can cause serious and fatal injuries. It also claims that the defendants knew of the side effects but failed to warn consumers. Also, the defendants willfully, intentionally and knowingly misrepresented the safety of the vaccine.

If you developed shingles, or your loved one did after being immunized, you may qualify to file a claim against the vaccination. However, you must have been vaccinated after the year 2006. More so, the shingles virus must have characterized itself after 3 weeks to one year of being vaccinated. Also, the diagnosis must be clinically proved.

You can also file claims against the vaccine if you contracted some injuries within two years of being vaccinated. The damages include neurological disorders, PHN, myelitis, hearing loss, autoimmune diseases, stroke, cardiovascular problems, vasculitis, pneumonia, congestive heart failure, and death.

To receive the compensation for the damages, you should file litigation against Merck and Company. Once you have successfully filed an indictment, you can be compensated for the injuries you got both non-economically and economically. Thus, you must be eligible to file the litigation first.
